This site is a platform for uploading materials for learning English through cultures and learning cultures through English, which is highly important if you wish to use English as a means of communication on a global level. It also creates opportunities for communicating with other participants across the world. When you use this facility, you will enter the domain of cross border communication; so, we insist that you carefully read and understand these Terms of Use before registering with our web-site.

To safeguard your security and comfort, we ask every user to respect our Terms of Use. The most important issues of this document have been summarized in our Rules to give you a quick idea of our policy. However, the legally binding document is this Terms of Use below, which must be read and agreed to before you register with our facility.

The Site www.WriteSpeakEnglish.com is a free educational platform intended to facilitate learning and teaching English through exposure to different cultures, international communication and cooperation. Since the function of WriteSpeakEnglish.com team is limited to providing a space for such activities, its maintenanance and making reasonable efforts to guide the participants to achieving the purpose declared in this Terms of Use, the actual situation on the Site may be different from the one described in these Terms of Use, in which case WriteSpeakEnglish is not liable for any deviation from the planned course of action.

1.2. The word “culture” is used here in its broadest meaning, incorporating all kinds of characteristics of national and social groups as carriers of any particular culture, such as their beliefs, pictures of the world, everyday behaviour and interaction patters, descriptions of the landscapes, weather and climate, glimpses of the localities, history insights, holidays, customs and traditions, tangible and intangible heritage, as well as arts, literature, and events.

1.3. The Site provides opportunities to engage in communication in English at the global level by means of:

a) participating in English speaking clubs;

b) creating and using culture-rich materials to explore the cultural diversity of the world and to present your culture to the world;

c) increasing your online visibility and creating opportunities for cross-border cooperation.

1.4. Our users can upload their creations about cultures to the COLORFUL WORLD Project. They can also publish their essays and other information in COMMUNITY TALK.

1.5. The end result of the Site is expected to be a collection of meaningful and valuable texts and multimedia, which can be employed for teaching and learning English at different levels in the global multicultural context.

1.6. This Site is NOT intended for discussions or personal interaction. Materials uploaded to WriteSpeakEnglish.com should be discrete posts. In case you disagree with something in materials uploaded by other users, you can create another post with no reference to the post you intend to challenge or contradict. The purpose of uploading the opposing opinion should not be to make everybody think in the same way, but to demonstrate the diversity of points of view.

1.7. This Site is not a social network. You are not expected to present your personal information, which has little value to the community. However, using your personal experiences as illustrations to cultural studies and sharing useful information about cultural events can be beneficial. 

We encourage our users to share posts on WriteSpeakEnglish.com in your social networks, blogs, on your websites, and also to share publications on the resources owned by you on WriteSpeakEnglish.com.

2. Users

2.1. The primary target groups of this Site are learners of English as consumers of the content and teachers of English as creators of the content. However, the site may be useful for users of learners of any category, especially those engaged in cross-cultural studies, working for international companies travellers, photographers, authors who are interested in cross-cultural issues.

2.2. It is expected that the uses of this Site shall have at least intermediate level of English as a foreign or Second language and possess sufficient information and computer literacy skills. If you cannot understand what is written on this Site or if you cannot understand how the Site works using the Help and advice of our technical support, then you probably need to take some additional training, which WriteSpeakEnglish.com shall not be responsible for. It is also your own responsibility to keep your hardware and software updated, so that you could enjoy working on the Site.

2.3. This facility does not set age limitations. However, it is required that leaners under the age of 14 use this facility under the supervision of the teacher, parent, or another trusted adult. The supervising adults are responsible for explaining these Terms of Use to the child in the manner that the child understands them. To ensure the parents’ awareness of the child’s engagement with this Site, the registration procedure requires that every user under the age of 14 provide his/her parent’s contact data and that the parents approve the registration. It is highly recommended that the parents supervise their child’s activities on this Site and together discuss the information the child receives.

2.4. As an educational facility, this Site can be monitored and mediated to ensure the safety and satisfaction of all its users. However the team of WriteSpeakEnglish.com does not guarantee that all the materials available from this Site or the external resources accessed from this Site will fully satisfy your needs and meet your expectations. WriteSpeakEnglish.com does not evaluate, verify or improve any of the materials submitted to this facility. The administration of WriteSpeakEnglish reserve the right, but not the obligation, to remove any content at our sole discretion, at any time and without a prior notice, if we find it offensive or dubious, and ban any user, whose behaviour is deemed inappropriate for an educational resource. You can help us keep this facility at a high level of safety and user satisfaction by reporting instantly any case of inappropriate behaviour or abuse observed by you.

2.5. In spite of our effort to monitor the content and moderate the communication occurring of the Site, we cannot guarantee that cases of disruptive behaviour, inappropriate content or other indecencies will be fully excluded. We are not responsible for the accuracy, completeness or usefulness of any content, nor do we endorse such content. We do not verify the identity of people using our Site.

By registering with the Site, you acknowledge that you may be exposed to content that you find objectionable, indecent or offensive or which is inaccurate, misleading or incomplete. You use the Site and the content at your own risk.

2.6. It is intended that through cooperation and interaction at WriteSpeakEnglish.com the participants and users will receive the benefits as follow:

The learners of English will have an access to high quality culture-rich learning materials and will be able to engage the services of the best teachers after considering their language, personality and teaching style, which will be revealed in the learning materials and the process of interaction. 

The teachers of English will have an opportunity to make their content and services visible globally, which can allow them to increase their audience dramatically and improve their services through sharing and exchange.

The native speakers of English can learn about other cultures, help learners of English better understand the culture of English speaking nations, publish their content and get to the global level of distribution.

2.7. All users enjoy equal rights. The posts that appear in the Recent Posts and the Latest Uploads  sections are selected automatically by the system and will remain there until the next post has been uploaded. If you want to be more visible, the way to do that is to create more materials, which comply with our Standards.  You can also increase your visibility by creating better quality materials, and if you ucceed, they will appear in the Most Popular section.

3.  The Code of Conduct and Content

To ensure smooth interaction and rewarding experiences at WriteSpeakEnglish.com we kindly ask every user to follow the simple rules that follow:

3.1. By registering with this facility you agree to abide by the general norms of decency and fair use of information, including, but not limited to:

• using this facility in line with its purpose as stipulated in p.1.1. of these Terms of Use and to refrain from any form of use that could harm the facility, its team, its owners, its providers or its users;

• being friendly and supportive towards all other participants;

• refraining from criticism or any form of disrespectful or disruptive behaviour;

• express your ideas in a clear, concise and stylistically appropriate form (avoid jargon, obscure expressions, foul language, and anything that might cause confusion and/or embarrassment, etc.).

You warrant that the content uploaded by you to this Site, does NOT infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party.

3.2. It is explicitly banned to upload any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually explicit, threatening, invasive of a person's privacy, promoting any kind of antisocial behaviour, inciting violence, racism, nationalism, discrimination, sexism, chauvinism, or which is otherwise in violation of any Belarusian or international law.

Anyone who feels that a message contained on the Site is objectionable, fraudulent, or against the objectives of the Project, is encouraged to notify the administrator or moderator of this Project immediately.

3.3. It is explicitly banned to use this Site to promote any businesses, products, services, ideas, political or religious groups, to run campaigns and engage in any activities other than the intended (see General Provisions, 1.1.). Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are strictly forbidden on this facility, and any users caught spamming will be banned from using this facility and their accounts will be removed.

The allowed ways to increase your visibility is by making a better contribution to the projects by means of writing comments, uploading learning materials, sharing information about cultural events, English learning opportunities, English learning tips and similar issues. In case of doubt, feel free to seek advice from our team.

3.4. Please, be aware that the posted messages express the views of the author, and not necessarily the views of the WriteSpeakEnglish.com community, its team, its affiliates, or its owner. The users, who upload the content, bear full responsibility for its accuracy and appropriateness. The users are also fully responsible for their behaviour and fulfilling the responsibilities they might enter through the communication on this facility.

The parents bear full legal responsibility for the actions of their underage children and they shall act as safeguards of their rights and safety.

3.5 You agree that you will not use any automated devices, such as spiders, robots or data mining techniques to catalog, download, store or otherwise reproduce, store or distribute content available on the Site, or to manipulate the Site or the Services, or otherwise exceed the limited access granted to you by WriteSpeakEnglish.com.

3.6. You are solely responsible for the actions performed under your screen name and for the content, posts and messages uploaded by you, or by somebody else under your ID. For this reason, do not disclose your login name and/or your password to anybody else, do not keep them is the written form in public or easily accessible places. It is recommended that you use a strong password and change it every month or more frequently.

3.7. The English language is the only language to be used in the COLORFUL WORLD and COMMUNITY TALK  sections. In ICAN CLUB and ICAN CLUB YL  sections, as well as on pages used by our sister-clubs a restricted use of local languages is allowed, such as for announcements or comments addressed to the local community served by these clubs. All information posted in languages other than English must be accompanied by its translation into English.

4. Intellectual Property Rights

This section governs three domains of the Site: its design, its content and the use of its content. Regardless of the type of the licence, in case of using the materials outside this facility, credit must be given to the author (you must mention the author’s name or the screen name) and to the source (i.e. you must mention WriteSpeakEnglish.com  + the URL of the material).

4.1. The design of WriteSpeakEnglish.com and its elements, including, but not limited to the texts, graphics, the code, the layout, the structure, the logos and brand names and all other technical means employed by WriteSpeakEnglish.com are fully protected by law in the form of (a) Copyright © V.Holubeva as stipulated in the contract between these two parties, or (b) Copyright stipulated in the license acquired by the owner of the site from the intellectual rights owners. While the public domain elements can be used by anybody without requesting any permission, WriteSpeakEnglish.com owns copyright to selection, coordination, arrangement, delivery and enhancement of the content uploaded to the Site. The content itself is provided under the Creative Commons Licence 4.0. International.

4.2. The use of the content

4.2.1. The use of the content created by the participants of the Site, including but not limited to texts, messages, graphics, charts, presentation, videos, etc., except photos and videos that feature individuals, is regulated by the Creative Commons licence 4.0. International. This licence allows using this type of content for private educational non-commercial purposes, and also allows adaptation of the materials and creation of derivatives for educational non-commercial use. Any commercial use of the materials (such as publishing on fee charging sites, in the books and other additions) is allowed only after obtaining a prior written permission of the author and intellectual rights owner of the material. To get this permission, one should contact the participant of the project, who uploaded the content to WriteSpeakEnglish.com. In any case of sharing our content on other sites/blogs, you must mention the name/ the screen name of thу author, the website, and the source. Your citation should look like this: name of the author +WriteSpeakEnglish.com+ the URL of the material).

4.2.2. The use of photos and videos that feature individuals is regulated both by Creative Commons 4.0 International License and privacy rights of the individuals. Photos and videos of individuals may be viewed online, downloaded and stored on your own computer for your private use only, but must not be altered and must not be reproduced in any form or by any means on any other electronic resources or in publishing without the prior written permission of two parties: (a) the author / copyright holder of the image/video and (b) the individual(s) that are featured in the image/video. To obtain the permissions, the request should be sent to WriteSpeakEnglish.com, who will contact the individuals in question.

4.2.3. The correct way of sharing the content published at WriteSpeakEnglish.com or at other online resources linked to this Site at your own site or blog or in social media is to copy the URL of the page / element your wish to share and paste the URL or embed it on the facility you want it to appear. In this case you do not need to obtain a permission of the creator, as the intellectual property remains on the Site where it was contributed to. Mentioning the author and the name of the source Site in your publication, is case it is not published automatically, is a must.

In case of sharing the content in this manner, the original idea of the material shared by you must NOT be distorted or used in a way that would corrupt the intention of the author. The fair use principle must be respected. The use of any piece of the content with the purpose to ridicule, contempt, or lower the esteem of any individual, organization or social group is explicitly prohibited.

4.3. The creation of the content

Participants are allowed to upload exclusively materials created by themselves or in cooperation with other individuals, and the intellectual property right will be automatically attributed to the name of the individual mentioned in the profile of the contributor unless other is explicitly stated. In case the materials contain any copyrighted elements, such as images, texts, numerical data, etc., the creator of the contend must (a) give credit to the author and (b) possess a written permission of the authors or copyright holders to use these elements under the Creative Commons 4.0 International licence.

When using any elements that are in public domain, the contributors to WriteSpeakEnglish.com must (a) give credit to the author and (b) explicitly mention that this element is in public domain and as such may be used by other participants without any limitations.

4.3.2. No form of plagiarism will be tolerated. Ensuring the correct authorship attribution is the responsibility of the creators of the content. WriteSpeakEnglish.com works under no obligation to, and is unable to scan all the content posted by our users for any violations of third party rights. However, we reserve the right to make such checks and remove any content on the Site, which infringes another person's copyright. Writespeakenglish.com will terminate a registered user’s account and access to the Site, if the user is determined to be a repeat infringer.

The creators of content bear full responsibility for respecting the intellectual property rights of the source materials they are using and for giving credit to their authors. In no event the team of WriteSpeakEnglish.com will be liable for copyright violations by the contributors.

4.3.3. As stipulated in 4.2.2, all the materials at WriteSpeakEnglish.com are available to our users under the Creative Commons 4.0 International licence. By uploading your materials to our facility you agree to this provision. No special copyright provisions will be made for any piece of content. If you as a content creator disagree with the terms of Creative Commons 4.0 International licence, you should NOT upload your content to WriteSpeakEnglish.com. Instead, you can create an Internet resource of your own and paste such content there and link it up to your content at WriteSpeakEnglish.com. 

4.2.4. The safeguard of the intellectual property rights of the content uploaded to WriteSpeakEnglish.com remains at the sole discretion of its creators/ copyright holders. In no event WriteSpeakEnglish.com will be responsible for any case of intellectual property right abuse by third parties or obliged to take legal action to restore the contributors’ rights, or liable for damages or loss of benefits caused by such abuse. The intellectual property rights disputes should be settled between the creators/ copyright holders of the content and the infringer, it such act is committed.

5. Privacy and Security

WriteSpeakEnglish.com respects your privacy and takes reasonable actions to protect your security.

5.1. Collecting and storing personal data is minimized. When you register with WriteSpeakEnglish.com, you will be asked to provide personally identifiable information that will enable the Site to identify you when you log in and direct you to your profile and also to better target our newsletters. When registering, you agree to provide (a) true, accurate, current and complete information about yourself as prompted by the registration form, and (b) maintain and properly update your profile to keep it true, accurate, current and complete.

We also provide an opportunity for you to create a more detailed profile, and which you can add to or change from time to time, but this will be optional. The personal information you upload on WriteSpeakEnglish.com will remain as confidential as you choose in your settings. We do not encourage our users to post unnecessary personal information.

If you provide information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that, we have the right to terminate your registration with us, block your account and/or remove your profile.

5.2. We do not disclose any personal information to third parties, unless by demand of the law enforcement or by other authorities, who have legal right to demand that. We do not sell personal data to any third parties and we will not use your contact data for any unsolicited mailing.

In case any user engages in any illegal, offensive, disruptive or hazardous activities, the ID will be banned and these activities will be reported to the law enforcement.

5.3. All users of WriteSpeakEnglish.com are expected to respect the privacy of other users. They are not allowed (a) attempt to access the unauthorised parts of other users’ accounts; (b) collect, store and share or abuse in any other way the information of other users they receive.

5.4. It is not allowed to publish personal data or sensitive information of other people or provoke people into disclosing such information. If your photo or video features any individual as the main subject, you must have a written permission from that individual to publish this content on the Internet. In case of featuring children, the permission must be signed by both their parents.

5.5. In the process of registration you will also be asked to select a screen name, which will serve to identify you as a registered user each time you visit the Site and allow you to access your account. You may not (a) select or use a screen name of another person (b) use a screen name that WriteSpeakEnglish.com, at its sole discretion, deems offensive or inappropriate for an educational resource.

5.6. To help other users identify you at the Site, it is recommended that you use an avatar, which can be your photo or another image. You are not allowed to use images of other people, or images that create a false impression of your gender and age. It is also not allowed to use photographs that may scare young learners, or can be deemed offensive or inappropriate for an educational resource in any other way. WriteSpeakEnglish.com reserves the right to remove such images at its sole discretion and ask the user to upload a more appropriate image.

5.7. By agreeing to these Terms of Use you acknowledge your awareness that by uploading any information on the Internet you can lose control of it. You acknowledge that deleting your Content and/or your Profile from this Site will not make the deleted content unavailable on the Internet, as due to caching and cross-references this information may remain stored on other locations.

Although the information uploaded to this facility is protected by the Creative Commons licence, this cannot safeguard you against possible personal data theft and intellectual right abuse. Being aware of these threats, you will fully assume your security responsibilities and you agree that you are solely responsible to any consequences of your behaviour on this facility.

We strongly recommend you NOT to disclose any sensitive personal details of yourself or any third party, and NOT to give anyone any contact data, such as your street address, telephone numbers, bank account, information about your income or indication of places where you can be easily found. We highly recommend NOT to send any money to anyone, who approaches you online, and immediately report any attempt to solicit money or other type of action, that can harmful you. 5.8. We encourage you to use updated versions of antivirus, antispam and antimalware programs on your computer, and not to install any program, which might be transmitted through this facility by third parties unnoticed by the Site owners and administrators.

5.9. You agree to indemnify and hold harmless the owners of this facility, its team, the host, and the online facilities linked to this site. 6.1. The facility is solely owned by its founder Valaintsina Holubeva and is operated by a small team of contractors and volunteers. The only person to contact on strategic issues, such as investment, partnership, advertising, etc. is Valaintsina Holubeva. The team can be contacted on technical issues associated with maintenance, troubleshooting, technical support, editing, etc. We all can be contacted through the feedback form.

6.2. WriteSpeakEenglish.com is open for partnership in any domain that is integral with the purpose of this facility (General Provisions 1.1) . To make your partnership offer, please, use CONTACTS.

6.3. WriteSpeakEenglish.com is an attractive project to invest in. Investment offers in WriteSpeakEenglish.com will be considered on a case by case basis. Please, visit the INVESTMENT page to learn more.

6.4. WriteSpeakEenglish.com is an excellent place to promote your business, product or service globally and locally. There are two allowed ways of doing this: (a) creating content for the Site (see 1.5.) and posting links from your profile to your facility or (b) placing an advertisement on WriteSpeakEenglish.com. The price to advertising services on WriteSpeakEenglish.com are determined on a case by case basis. The only person authorised to conclude a contract for advertising on WriteSpeakEenglish.com is Valiantsina Holubeva, who can be contacted from. You can also engage adverting services of our partners or other participants of the project, in which case these parties will place your  advertisements elsewhere, and in this case WriteSpeakEenglish.com bears no liability.

It is strictly prohibited to place ads of any business, product or service in your posts, comments or content you upload to WriteSpeakEenglish.com without a prior written permission from Valiantsina Holubeva, the Site’s owner. The allowed place for your business information is your profile and the key words you choose to go to the list of the participants of the Site.. If content creators want to insert any promotional material of third parties, they must contact Valiantsina Holubeva to negotiate the terms and conditions for each case.

6.5. WriteSpeakEnglish.com itself is entirely free to use, but it might contain third parties’ offers of fee charging services or content. When following the links published on WriteSpeakEenglish.com, please, check the domain name of the facility you are directed to and read the terms and conditions of the sites, if the domain name is different from WriteSpeakEnglish.com. WriteSpeakEnglish.com does not examines, evaluates or controls the external resources, and thus is not responsible for any content, services or actions on those sites. You must be aware that if you decide to stay on those facilities, you will act at your own risk. In case you generate any income from your own facilities linked to WriteSpeakEnglish.com, it is your full responsibility to pay taxes and other duties in accordance with the legal requirements of your country. WriteSpeakEnglish.com does not control or is responsible for any financial deals or transactions performed by its users.
